A petition has been filed in the Delhi High Court seeking a stay on the release and streaming of the upcoming Netflix film Ghooskhor Pandat. The plea alleges that the title and promotional material of the project amount to collective defamation of the Brahmin community and are offensive and derogatory.
The writ petition was filed by Mahender Chaturvedi, who describes himself as an Acharya devoted to teaching and spreading Indian scriptures and spiritual traditions. He claims that the movie’s title unfairly links the word “Pandat” with corruption and bribery, harming the dignity and reputation of the Brahmin community.
According to the plea, the term “Pandat” has historical and cultural significance as a respected designation associated with scholarship, moral authority, ethical conduct and spiritual guidance in Indian society. The petitioner argues that the allegedly defamatory portrayal amounts to stereotyping an entire community, which he says violates their right to dignity and reputation.
The petition contends that the title and content are communally offensive and violate fundamental rights guaranteed under the Indian Constitution, including Articles 14 (equality before law), 21 (right to life and personal liberty) and 25 (freedom of religion and cultural practice). It states that the content discriminates against a particular religious and social group.
While the plea acknowledges the right to freedom of speech and expression under Article 19(1)(a), it emphasises that this right is not absolute and does not protect content that may amount to hate speech, defamation, or material that could disrupt communal harmony and public order under Article 19(2).
The petitioner has also made the Union Government of India a party to the case, arguing that the government has failed to set up an effective regulatory mechanism to prevent misuse of creative freedom on OTT (over-the-top) platforms, which could allow sensational or community-based vilification for commercial gain.
Through the petition, the plea seeks a stay on the film’s release and streaming until the case is heard. It also asks for directions to Netflix India and the government to take appropriate action against the content makers and enforce applicable laws governing digital media and OTT platforms.
The film Ghooskhor Pandat, featuring Manoj Bajpayee in the lead role, was announced by Netflix with a teaser and promotional material that triggered backlash on social media. Many users criticised the title as offensive and demanded a change, with some even threatening a boycott of the film if the title was not altered.
So far, Netflix India has not issued an official response to the legal challenge or related criticism. The case is expected to be heard by the High Court as the release date approaches.
