Shashi Tharoor Introduces Bill to Criminalise Marital Rape

In a significant move, Congress MP Shashi Tharoor has introduced a private member’s bill in the Lok Sabha to criminalise marital rape in India. The bill aims to change the existing law, which currently does not treat non-consensual sex within marriage as a crime.

What the Bill Proposes

The bill clearly states that sexual intercourse without consent, even within marriage should be considered rape.
Tharoor stressed that India must move toward a modern understanding of consent, saying:

“No means no. Only yes means yes.”

This means that marriage should not automatically imply consent, and a spouse’s refusal must be respected.

Why This Is Important

For many years, women’s rights organisations, legal experts and activists have been calling for India to recognise marital rape as a crime. They argue that:

  • Marriage cannot be used as a shield for violence

  • Consent should apply in every situation

  • Women in abusive marriages need legal protection

Tharoor’s move brings the issue back into national debate at a time when discussions around gender equality, bodily autonomy and personal safety are gaining more public attention.

Growing Public Support and Debate

The introduction of the bill has created strong discussions across the country.
Many people welcomed the proposal, saying it is essential for protecting women and recognising their rights within marriage. Others argue that the matter needs deeper discussion to avoid misuse and to protect both partners.

Despite differing opinions, one thing is clear: the conversation around consent within marriage is louder than ever before.

What Happens Next?

As a private member’s bill, it will now be reviewed and debated in Parliament. While such bills are rarely passed, they often play an important role in bringing big issues into the public spotlight.

Experts believe this bill could push India closer to reforming old laws and making consent a central part of married relationships as well.
